Sec. 5.

(a) The division may require all regulated amusement devices to be tested as set forth in 685 IAC 1-2-5 [675 IAC 31-2-5] . A letter of the results of the examination shall be:

(1) maintained on site with the affected regulated amusement devices; and

(2) made available to:
(A) the director of the elevator and amusement safety section; and

(B) any inspector;

of the division upon request.

(b) Any regulated amusement device damaged by a breakdown or in a highway or midway accident shall comply with the nondestructive testing section, Section 8, of ASTM F 846-92 (2003), as set forth in 685 IAC 1-2-5 [675 IAC 31-2-5] , when the division deems it necessary in order to determine whether or not the regulated amusement device is capable of operating in compliance with this rule. This requirement applies to any regulated amusement device that is subject to nondestructive testing, whether newly constructed or existing.
