Sec. 17.

(a) An amusement device shall be placed on stable blockings or surfaces and be secured to prevent shifting, tipping, swaying, or erratic motion. The provision pertinent to erratic motion or sway does not apply to an amusement device designed to permit flotation characteristics or flexibility. Use of shim blocks shall be limited to the number needed to achieve stability. Drainage shall be provided to prevent water from collecting and softening supporting areas. The area surrounding the amusement device shall be clear and kept free from trash and tripping hazards.

(b) A fixed amusement device permanently erected in an amusement park shall be filed and a design release issued in accordance with the general administrative rules of the fire prevention and building safety commission, 675 IAC 12-6, and shall be set on designed and constructed foundations or footings and secured to these footings in a manner to prevent shifting, tipping, swaying, or erratic motion. The provisions pertinent to erratic motion or sway does not apply to an amusement device designed to permit flotation characteristics or flexibility.

(c) Nothing in this section shall be construed to prohibit the assembly of an amusement device in accordance with the manufacturer's recommendation.
