Section 1.2-4 - Signatories to design release application

Sec. 4.
(a) All design release applications must be signed by the manufacturer as follows:
(1) For a corporation, the signatory shall be
a responsible corporate officer. For the purpose of this section, "responsible
corporate officer" means a president, secretary, treasurer, or vice president
of the corporation in charge of a principal business function, or any other
person who performs similar policy making or decision making functions for the
corporation.
(2) For a partnership
or sole proprietorship, the signatory shall be a general partner or the
proprietor, respectively.
(3)
Alternatively, a duly authorized representative of a signatory listed under
subdivision (1) or (2) may be the signatory on the application. A person is a
duly authorized representative only if:
(A)
the authorization is made in writing by an individual described in subdivision
(1) or (2);
(B) the authorization
specifies either an individual or a position having responsibility in the
industrialized building or mobile structures manufacturing facility of plant
manager, superintendent, position of equivalent responsibility, or an
individual or position having overall responsibility for building and fire
safety matters for the manufacturer; and
(C) the written authorization is submitted to
the office of the state building commissioner, if requested.
(b) The manufacturer shall make the following affirmation on the application: I affirm, under penalty of perjury, that:
(1) the proposed
industrialized building system or mobile structure will be fabricated in
compliance with all applicable rules of the commission; and
(2) the construction of the proposed
industrialized building system or mobile structure will not deviate from the
plans and specifications submitted with the application and released by the
office of the state building commissioner except as authorized under section 11
of this rule.
(c) If a design professional is required by section 8 of this rule, the design professional shall make the following affirmation on the application: I affirm under penalty of perjury that:
(1) the
information contained in the application is true, accurate, and
complete;
(2) the plans and
specifications submitted with the application:
(A) were either prepared by myself or under
my direct supervision; and
(B)
provided for the industrialized building system or mobile structure will meet
all building laws as that term is defined by IC
22-12-1-3; and
(3) I will inspect the construction covered
by the application at intervals appropriate to the stage of the fabrication to
verify and ensure that the work is proceeding in accordance with the system
release.
