Sec. 5.
(a) An education scholarship student's enrollment in a public school terminates the student's education scholarship account. Upon enrollment in a public school, the public school, in consultation with the student's parent, must immediately provide the student with services comparable to those described in the student's ESA service plan initially offered under section 3 [sic, of this rule] until the public school develops, adopts, and implements an IEP that meets the requirements of 511 IAC 7-42. The CCC must be convened within ten (10) instructional days of enrollment of a student who had been receiving services through an educational scholarship account education service plan.
(b) Upon enrollment in a public school, the parent of an eligible student or an emancipated eligible student, as well as the public school, shall immediately notify the treasurer of state, and the public school shall immediately notify the department of the student's enrollment in a public agency.
(c) The treasurer of state shall notify the parent of the termination of the education scholarship account upon the enrollment of the student in a public school.
