Section 8-3 - Application procedures; implementation of proposed courses or programs

Sec. 3.

(a) The governing body charged with administering a public or nonpublic school desiring to implement a nonstandard course or curriculum program shall submit an application for waiver to the department at least five (5) months prior to the planned implementation of the course or curriculum program; however, initial proposals involving a major modification in the operation of a school or school corporation shall be submitted at least eight (8) months prior to the planned implementation.

(b) An application for an extension of a waiver, along with a report of the evaluation for the expiring waiver period, shall be submitted at least three (3) months prior to the beginning of the extension period.

(c) Amendments to previously approved waivers shall be submitted at least three (3) months prior to the planned implementation of any proposed modification of the original proposal requiring:

(1) the waiver of additional rules of the board; or

(2) expansion of the course or program to additional schools.

(d) The governing body shall finalize no contracts required for the implementation of the proposed course or curriculum program prior to waiver approval by the department.
