Section 10-5 - Waivers of rules and statutes

Sec. 5.

(a) Upon designation as an Indiana 2000 school, a school corporation, on behalf of its Indiana 2000 schools, or an accredited nonpublic school may, after notifying the state board, invoke a waiver of any rule adopted by the state board except this rule.

(b) The state board, upon request of an Indiana 2000 school, may waive any statute relating to curriculum or textbook selection that is identified by the school and the state board as affecting, restricting, or otherwise limiting the school in making management and operational decisions with regard to curriculum matters or textbook selection. Statutes that relate to curriculum and textbook selection include, but are not limited to, the following:

(1) IC 20-33-5 to the degree that it prohibits schools from receiving a reimbursement for textbooks that have not been adopted by the state board.

(2) IC 20-30-5 concerning mandatory curriculum requirements.

(3) IC 20-20-10[IC 20-20-10 was repealed by P.L. 286-2013, SECTION 34, effective July 1, 2013.] concerning the technology preparation curriculum.

(4) IC 20-30-6 concerning optional curriculum requirements.

(5) IC 20-20-5[IC 20-20-5 was repealed by P.L. 73-2011, SECTION 22, effective July 1, 2011.] concerning textbook adoption requirements.

(6) IC 20-26-12 to the degree that it limits the purchase and rental of textbooks to those adopted by the state board.

(7) IC 20-26-12 to the degree that it applies only to textbooks that areadopted by the state board.
