Sec. 4.

(a) Pursuant to the executed provider agreement, a service provider shall furnish at least thirty (30) days written notice to:

(1) the individual;

(2) the legal representative, if applicable;

(3) the case manager, as applicable; and

(4) the Medicaid waiver specialist; before terminating waiver services to an individual.

(b) If the provider is furnishing direct services, before termination, the provider shall participate in an interdisciplinary meeting to coordinate the transfer of services to a new provider. The provider shall agree to continue serving the individual until a new provider furnishing similar services is in place, unless written permission has been received from the state's Medicaid waiver specialist authorizing the services to cease.

(c) If the provider is furnishing CMS, the provider shall participate in an interdisciplinary meeting at which the new case manager is present. The purpose of the interdisciplinary meeting will be to coordinate the transfer of services to the new case manager. The provider shall agree to continue serving the individual until a new case manager is furnishing service, unless written permission has been received from the state's Medicaid waiver specialist authorizing the services to cease.
