Section 1.6-2 - Emergency services

Sec. 2.
(a) If a hospital provides a community emergency service, the service shall meet the emergency needs of the patients served, within the scope of the service offered, in accordance with acceptable standards of practice, and be under the direction of a physician qualified by education or experience.
(b) The emergency service shall have the following:
(1) A scope of service that is
clearly defined.
(2) Written
policies and procedures governing medical care provided in the emergency
service are established by and are a continuing responsibility of the medical
staff. The policies shall include, but not be limited to, the following:
(A) Provision for the care of the disturbed
patient.
(B) Provision for
immediate assessment of all patients presenting for emergency and obstetrical
care.
(C) Provision for transfer of
patients when care is needed which cannot be provided.
(3) Integration with other hospital
services.
(4) Laboratory and x-ray
services available at all times.
(5) Adequate qualified medical and nursing
personnel available to meet the needs anticipated by the facility in accordance
with 410 IAC 15-1.4-1 and
410 IAC 15-1.5-6, which includes,
but is not limited to, the following:
(A) A
registered nurse on duty and available to patients presenting with an emergency
condition, on a twenty-four (24) hours per day, seven (7) day per week
basis.
(B) A physician available at
all times in accordance with
410 IAC 15-1.4-1(d)(3)
and attending to patients with an emergency
condition.
(6) A
physician on-call roster available in the emergency service department which
lists medical specialists in addition to scheduled medical staff.
(7) A patient control register.
