Sec. 1.

(a) Except as provided in subsections (b) through (d), the requirements in this article apply to all persons that store:

(1) minibulk pesticide containers;

(2) bulk pesticide containers; or

(3) pesticides within a wellhead protection area.

(b) The requirements in this article do not apply to persons that transport, but do not otherwise store, unopened pesticide containers.

(c) The requirements for operational area containment in 355 IAC 5-3 do not apply to persons that store antimicrobial pesticide containers labeled for legal use in:

(1) food handling or storage establishments premises and equipment;

(2) commercial, institutional, and industrial premises and equipment;

(3) residential and public access premises;

(4) medical premises and equipment;

(5) human drinking water systems;

(6) materials preservatives;

(7) industrial processes and water systems;

(8) antifouling coatings;

(9) wood preservatives; or

(10) swimming pools.

(d) The requirements for operational area containment in 355 IAC 5-3 and secondary containment in 355 IAC 5-4 do not apply to persons that store minibulk pesticide containers for less than forty-five (45) days, as verified by written delivery documentation.
