Section 8-3 - Stop sale, use, or removal orders

Sec. 3.
(a) If the state chemist determines that a manure based fertilizer is being offered for sale in violation of this article, the state chemist may issue to and enforce upon the owner or custodian:
(1) a written or
printed stop sale, use, or removal order; and
(2) a written or printed order to hold the
manure based fertilizer at a designated place until:
(A) the owner or custodian complies with this
article;
(B) the state chemist
releases the manure based fertilizer in writing; or
(C) the violation is legally disposed of by
written authority.
(b) The state chemist shall release manure based fertilizer withdrawn under subsection (a) when:
(1) the owner or custodian complies with this
article; and
(2) all costs and
expenses incurred in connection with the withdrawal have been paid.
