Sec. 4.

The owner and operator shall maintain records in accordance with 40 CFR 280.34 * and this article that are capable of demonstrating compliance with closure requirements under this rule. The results of the site assessment required in section 2.5 of this rule must be submitted to the department within thirty (30) days after completion of closure or change-in-service of the UST system. Results of the site assessment must be maintained for at least three (3) years after completion of closure or change-in-service in one (1) of the following ways:

(1) By the owner and operator who took the UST system out of service.

(2) By the current owner and operator of the UST system site.

(3) By mailing these records to the department, if the records cannot be maintained at the closed facility.
