Section 13-8 - Draft permits

Sec. 8.
(a) Once an application is submitted, the commissioner shall either prepare a draft permit to issue a final state permit or prepare a draft permit to deny the final state permit.
(b) A draft permit prepared by the commissioner shall contain the following information:
(1) All conditions under
40 CFR
270.30 and
40 CFR
270.32.
(2) All compliance schedules under
40 CFR
270.33.
(3) All monitoring requirements under
40
CFR 270.31.
(4) Standards for treatment, storage,
recovery, and/or disposal and other permit conditions under
40 CFR
270.30.
(c) All draft permits prepared under this section shall be:
(1) accompanied by a fact
sheet under section 9 of this rule;
(2) publicly noticed under section 10 of this
rule; and
(3) made available for
public comment under section 11 of this rule. (d) The commissioner shall:
(1) give notice of opportunity for a public
hearing under section 12 of this rule;
(2) issue a final decision under section 14
of this rule; and
(3) respond to
comments under section 13 of this rule.
