Sec. 3.
(a) Any permittee required to monitor under this article or by any permit issued pursuant to this article, shall maintain all records of all monitoring information and monitoring activities, including:
(1) the date, exact place, and time of the
sampling or measurements;
(2) the
person or persons who performed the sampling or measurements;
(3) the date or dates analyses were
performed;
(4) the person or
persons who performed the analyses;
(5) the analytical techniques or methods
used; and
(6) the results of such
measurements or analyses.
(b) All records of monitoring activities and results shall be retained by the permittee for five (5) years. The five (5) year period shall be extended:
(1)
automatically during the course of any unresolved litigation between the
commissioner and a permittee; or
(2) as required by the permit
conditions.
