Sec. 1.
(a) The following are excluded from regulation under this article:
(1) Facilities that hold a valid permit under
329 IAC 10 or 329 IAC 11 to treat, process, store, or dispose of solid or
hazardous waste that are not described in
329 IAC 11.7-1-1.
(2) Processing of uncontaminated
and untreated natural growth solid waste and sawdust including the following:
(A) Tree limbs.
(B) Stumps.
(C) Leaves.
(D) Grass clippings.
(3) Facilities permitted under 329 IAC 3.1
that store, treat, or dispose of nonhazardous solid waste where such solid
waste is treated or disposed of as a hazardous waste at the receiving hazardous
waste facility.
(4) Processing and
burning for fuel of manufactured wood waste for purposes of energy consumption
on-site.
(b) If a facility is registered under this article, and accepts waste tires as an alternative fuel, then a registration is not required under 329 IAC 15. However, the facility must still comply with storage, operation, closure, and financial assurance requirements under 329 IAC 15 for tire processing prior to burning.
