Sec. 3.

(a) The commissioner shall review the information submitted and prioritize permit determinations based upon an assessment of the health and environmental threat posed by the disposal activity. To achieve prioritization the commissioner shall consider the data, or lack of data, regarding the characteristics of the material and the current disposal method.

(b) To the extent practical, the commissioner shall endeavor to process permits for solid waste land disposal facilities that dispose of similar types of solid wastes in the same time period to allow industrial categories to share data collection efforts.

(c) In cases where the commissioner determines that further data is needed to adequately evaluate the disposal activities for the purposes of issuing a permit, the commissioner shall provide written notice of such requirements to the facility and allow a reasonable time period for compliance with requests for additional information.
