Sec. 3.
(a) Owners or operators of a construction/demolition site shall apply no less than two (2) feet of final cover over any area in the fill within one hundred eighty (180) days when:
(1) solid waste has not been
disposed for one (1) year; or
(2)
any area of the construction/demolition site has been filled to its approved
elevation.
(b) The construction/demolition site must meet the following requirements for final cover:
(1) The maximum projected erosion rate
must be five (5) tons per acre per year.
(2) The final compacted cover must be as
specified in subsection (a).
(3)
The final cover must have a slope of not less than two percent (2%) and not
greater than thirty-three percent (33%).
