Section 21-12 - Public notice for corrective action

Sec. 12.
(a) This section applies to owners, operators and permittees of MSWLFs.
(b) Any owner, operator, or permittee required to conduct an assessment of corrective measures, as described under section 13(d) of this rule, shall conduct a public meeting as follows:
(1) The meeting must be held within sixty
(60) days after the owner, operator, or permittee has completed an approved
assessment of corrective measures.
(2) The meeting must be held in the county
where the MSWLF requiring the assessment of corrective measures is
located.
(3) The meeting must be
open to all persons.
(4) At least
ten (10) days prior to the meeting, the owner, operator, or permittee shall
publish notice of the public meeting in a newspaper of general circulation in
the county where the public meeting will be held.
(5) The meeting must be transcribed by a
court reporter.
(6) At the public
meeting, the owner, operator, or permittee shall:
(A) present a brief description of the
location and operation of the MSWLF;
(B) review the assessment of potential
corrective measures, including:
(i) an
analysis of the effectiveness of potential corrective measures in meeting all
remedy requirements and objectives, as described under section 13(e) of this
rule;
(ii) the performance,
reliability, ease of implementation, and potential impacts of appropriate
potential remedies, including safety impacts, cross-media impacts, and control
of exposure to any residual contamination;
(iii) the time required to begin and complete
the remedy; and
(iv) the costs of
remedy implementation;
(C) offer the opportunity for public comments
and questions; and
(D) attempt to
answer the public's questions.
(7) The owner, operator, or permittee shall
submit to the department within thirty (30) days after the date of the meeting:
(A) a complete transcript of the public
meeting; and
(B) a copy of the
newspaper notice announcing the public meeting.
(c) The owner, operator, or permittee shall pay the costs of complying with this section.
