Sec. 21.
(a) Provided prior approval from the commissioner is obtained, leachate generated by an MSWLF may be recycled into portions of an MSWLF unit that is designed with either of the following:
(1) A composite
liner and a leachate collection system that meet the requirements of 329 IAC
10-17.
(2) An alternative design
that is permitted under either:
(A)
329
IAC 10-17-15; or
(B) 329 IAC 2, which was repealed in 1996,
provided the design is demonstrated to be at least as stringent as the design
standards described in
40 CFR
258.40.
(b) To obtain approval, the owner, operator, or permittee of the MSWLF unit receiving the recycled leachate must submit to the department the following:
(1) A
demonstration that the depth of leachate on the composite liner will not exceed
one (1) foot.
(2) A narrative
description of the current status of ground water monitoring under 329 IAC
10-Sec. 21.
(3) A demonstration
that there is no indication of liner failure as determined by monitoring of the
leak detection system, described in section 19 of this rule, if a leak
detection system is required.
(4) A
demonstration that the proposed method of recycling shall not be responsible
for odors, contamination of run-off, or damage to vegetation.
(c) Leachate recycling must not create odors, contamination of run-off, or damage to vegetation.
