Sec. 7.
(a) An easement, deed restriction, or right-of-way granted for a production well must:
(1) prohibit the construction of any
permanent structure, with the exception of structures associated with the
housing of the well equipment, over the production well; and
(2) provide access to the production well
site for maintenance purposes.
(b) A permit or exemption required by another goverrmient entity for a production well must be obtained prior to the commencement of construction under this rule.
