Sec. 7.
(a) For use in this section, the public water system's capacity, the average daily customer demand, and the peaking factor shall be calculated by the methods outlined in 327 IAC 8-3.3-2.
(b) In addition to the issuance requirements for a construction permit described in 327 IAC 8-3-4, the commissioner may deny an application for construction of a water main extension unless the applicant submits evidence that the following issuance requirements are met:
(1) The public water system's current two (2)
year average peak is less than ninety percent (90%) of the public water
system's capacity.
(2) The sum of
the public water system's current two (2) year average peak and the product of
the following is less than ninety percent (90%) of the public water system's
capacity:
(A) The average daily customer
demand resulting from the proposed water main extension.
(B) The peaking factor resulting from the
proposed water main extension.
