Sec. 14.
(a) This section applies to the following systems:
(1)
A Subpart H system using an uncovered finished water storage
facility.
(2) A PWS that purchases
water from a Subpart H system where the purchasing system uses an uncovered
finished water storage facility.
(b) A PWS shall notify the commissioner of the use of each uncovered finished water storage facility not later than the effective date of this rule.
(c) A PWS shall meet the following conditions for each uncovered finished water storage facility or be in compliance with a schedule approved by the commissioner to meet these conditions not later than April 1, 2009:
(1) A PWS shall cover any uncovered finished
water storage facility.
(2) A PWS
shall treat the discharge from the uncovered finished water storage facility to
the distribution system to achieve inactivation or removal or both of at least
4-log virus, 3-log Giardia lamblia, and 2-log Cryptosporidium using a protocol
approved by the commissioner.
(d) Failure to comply with the requirements of this section is a violation of the treatment technique requirement.
