Sec. 4.
(a) A storage or treatment facility must be constructed to prevent:
(1) leaks and seepage; and
(2) spills that could enter waters of the
state.
(b) The commissioner may incorporate conditions into the septage management permit that require testing to verify the storage or treatment facility's septage management system:
(1) is consistent with the
design standards; and
(2) meets the
performance standards established in this article.
