Section 23-5 - Reclassification of wastewater treatment plants

Sec. 5.
(a) A wastewater treatment plant may be reclassified by the commissioner if any of the following situations exist:
(1) The
wastewater treatment plant utilizes special or complex equipment or features of
design requiring more difficult operation.
(2) The wastewater is unusually difficult to
treat.
(3) More than ordinary
chemical, bacteriological, or biological nutrient removal controls are
required.
(4) An unusually high
degree of skill is required in the operation of the wastewater treatment plant
to ensure continuous production of effluent that meets the water quality
requirements of the receiving stream and the NPDES permit
limitations.
(5) A significant
change occurs to the wastewater treatment plant by the addition or removal of
the following:
(A) Flow volume.
(B) Equipment.
(C) Pollutant loading.
(D) Wastestreams.
(E) Treatment processes.
(b) When considering reclassification of a wastewater treatment plant, the commissioner shall do the following:
(1) Base reclassification of the
wastewater treatment plant on information:
(A)
supplied by the governing body or owner in a construction permit application
for modification of the wastewater treatment plant;
(B) supplied by the governing body or owner
in a NPDES or industrial waste pretreatment (IWP) permit application or
application for modification of an NPDES or IWP permit; or
(C) identified by the department that is
applicable to the classification of the wastewater treatment plant.
(2) Give written notice of a
reclassification to the governing body or owner and to the responsible charge
operator indicating the following:
(A) The
classification of certified operator that is necessary to supervise the
reclassified wastewater treatment plant.
(B) A date by which time a certified
operator:
(i) is required to comply with
clause (A); and
(ii) must be in
responsible charge of the reclassified wastewater treatment plant.
(c) The permittee shall notify the commissioner of any significant change or planned change to the wastewater treatment plant or contributing wastestreams that may be cause for a change in classification.
