Rule 23 - Wastewater Treatment Plant Classification and Operator Certification
Section 23-1 - Applicability

Sec. 1.
(a) This rule applies to the following persons or entities involved in the operation of a wastewater treatment plant:
(1) An
apprentice or a certified operator.
(2) A person applying to become an apprentice
or a certified operator.
(3) The
owner or governing body of a wastewater treatment plant.
(b) This rule does not apply to the following:
(1) Pits and ponds used to capture
stormwater or groundwater when any of the following conditions exist:
(A) The pit or pond is designed and used
solely for purposes of stormwater detention or retention.
(B) The pit or pond does not receive or treat
industrial or sanitary wastewater.
(C) The pit or pond is aerated, and the
aeration is intended only:
(i) for
aesthetics; or
(ii) to provide for
dissolved oxygen, but not for the purpose of promoting biological growth or
treatment of organic loading.
(2) The discharge and management of
wastewater discharged from pipelines conducting hydrostatic testing, unless the
commissioner finds it necessary, on a case-by-case basis, to classify the
discharge in accordance with section 4(a) of this
rule.
