Section 7-11 - Administrative permit amendments

Sec. 11.
(a) An administrative permit amendment is a Part 70 permit revision that does any of the following:
(1) Corrects typographical
errors.
(2) Identifies a change in
the name, address, or telephone number of any person identified in the Part 70
permit or provides a similar minor administrative change at the
source.
(3) Requires more frequent
monitoring or reporting by the permittee.
(4) Allows for a change in ownership or
operational control of a source where the commissioner determines that no other
change in a Part 70 permit is necessary, provided that a written agreement
containing a specific date for transfer of a Part 70 permit responsibility,
coverage, and liability between the current and new permittee has been
submitted to the commissioner.
(5)
Incorporates into a Part 70 permit the requirements from preconstruction
permits issued under section 10.5 of this rule that have satisfied the
requirements of sections 17 and 18 of this rule as appropriate.
(6) Incorporates into a Part 70 permit a
general permit issued under section 13 of this rule.
(7) Revises descriptive information where the
revision will not trigger a new applicable requirement or violate a permit
term.
(8) Incorporates:
(A) an exempt unit as described in 326 IAC
2-1.1-3;
(B) an insignificant
activity as defined in 326 IAC 2-7-1(21); or
(C) a PAL small emissions unit as defined in
326 IAC 2-2.4-2(l) or 326 IAC 2-3.4-2(l); that does not otherwise constitute a
modification for purposes of section 10.5 or 12 of this rule.
(b) Administrative Part 70 permit amendments, for purposes of the acid rain portion of a Part 70 permit, shall be governed by regulations promulgated under Title IV of the CAA.
(c) An administrative Part 70 permit amendment may be made by the commissioner consistent with the following:
(1) The commissioner shall take no more than
sixty (60) days from receipt of a request for an administrative Part 70 permit
amendment to take final action on the request and may incorporate the changes
without providing prior notice to the public or affected states provided that
it designates these Part 70 permit revisions as having been made under this
subsection.
(2) The commissioner
shall submit a copy of a revised Part 70 permit to the U.S. EPA.
(3) The source may implement the changes
addressed in the request for an administrative amendment immediately upon
submittal of the request.
