Sec. 9.

Any permit to construct or operate or any permit revision approval, permit modification approval, or source modification approval granted by the commissioner may be revoked for any of the following reasons:

(1) Violation of any conditions of the permit, permit revision approval, permit modification approval, or source modification approval.

(2) Failure to disclose all the relevant facts or misrepresentation in obtaining the permit, permit revision approval, permit modification approval, or source modification approval.

(3) Changes in regulatory requirements that mandate either a temporary or permanent reduction of discharge of contaminants. However, the amendment of appropriate sections of a permit shall not require revocation of a permit.

(4) Noncompliance with an order issued under 326 IAC 1-5 to reduce emissions during an air pollution episode.

(5) For a permit authorizing construction, failure to commence construction of the source or emissions unit within eighteen (18) months from the date of the issuance of the permit or if, during the construction of the source or emissions unit, work is suspended for a continuous period of one (1) year or more.

(6) Any other cause that establishes in the judgment of the commissioner the fact that continuance of the permit, permit revision approval, permit modification approval, or source modification approval is not consistent with the purposes of this article.
