Sec. 5.

(a) An owner or operator of a demolition or renovation activity subject to this rule shall pay a fee to the department for each asbestos project for which a notification is required under section 1 of this rule as follows:

(1) One hundred fifty dollars ($150) per facility for a demolition or renovation operation involving greater than or equal to:
(A) two thousand six hundred (2,600) linear feet of friable ACM on or off pipes;

(B) one thousand six hundred (1,600) square feet of friable ACM on or off other facility components; or

(C) four hundred (400) cubic feet of friable ACM on or off all facility components.

(2) Fifty dollars ($50) per facility for a demolition or renovation operation involving less than:
(A) two thousand six hundred (2,600) linear feet of friable ACM on or off pipes;

(B) one thousand six hundred (1,600) square feet of friable ACM on or off other facility components; or

(C) four hundred (400) cubic feet of friable ACM on or off all facility components.

(b) The department shall bill the owner or operator who submits notifications pursuant to section 1 of this rule on a quarterly basis as determined by the number of notifications received during the previous quarter.

(c) Fees must be paid:

(1) by mail or in person;

(2) upon billing;

(3) by check or money order;

(4) payable to "Cashier, Indiana Department of Environmental Management"; and

(5) no later than thirty (30) days after receipt of billing.
