Section 6-19 - Hydrologic balance; acid-forming and toxic-forming spoil

Sec. 19.

Drainage from acid-forming and toxic-forming spoil into ground and surface water shall be avoided by doing the following:

(1) Identifying, burying, and treating where necessary, spoil that in the judgment of the director, may be detrimental to vegetation or may adversely affect water quality if not treated or buried.

(2) Preventing water from coming into contact with acid-forming and toxic-forming spoil in accordance with section 50 of this rule.

(3) Burying or treating all acid-forming or toxic-forming spoil within a reasonable period of time. If the director determines that such spoil is detrimental to the off site hydrologic balance, the permittee shall bury or treat the acid-forming or toxic-forming spoil within thirty (30) days.
