Section 4-2 - Permits and exploration applications; responsibilities

Sec. 2.

(a) Persons seeking to engage in surface coal mining and reclamation operations must submit an application for and obtain a permit for those operations in accordance with section 1 of this rule, this section, and sections 3 through 134 of this rule.

(b) Persons seeking to conduct exploration must first file the notice of intention or obtain approval of the director as required under sections 9 through 15 of this rule.

(c) Following the submission by the director of a regulatory program under 30 CFR, Subchapter C, the director shall provide to the applicant written format for permit applications.
