Section 10-1 - Definitions

Sec. 1.
The following definitions apply throughout this rule:
(1) "Eligible retiree" means an individual who:
(A) has at least ten (10) years of
creditable service with a state agency;
(B) retires after June 30, 2000;
(C) has accrued but unused and uncompensated
sick, vacation, or personal leave on the employee's retirement date;
and
(D) has not previously received
the benefits of converting leave under this rule.
(2) "Retire" means to terminate state employment at a time when an eligible retiree is entitled to begin receiving pension benefits from a public pension plan as a result of the retiree's state service.
(3) "State agency" means:
(A) an authority;
(B) a board;
(C) a branch;
(D) a commission;
(E) a committee;
(F) a department;
(G) a division; or
(H) other instrumentality of state
government; but does not include a state educational institution, as defined in
IC 21-7-13-32, a state elected
official's office, and the legislative and judicial branches of state
government.
