Section 6-5 - Contract bid award criteria; rejection or waiver of nonconforming bids

Sec. 5.

All bids shall conform to all applicable requirements of the specifications including the instructions to bidders, general conditions, and special conditions. The bid officer shall:

(1) tentatively reject any bid failing to adhere to or conform to such;

(2) inform the director or in his or her absence the commissioner of this fact; and

(3) await a decision as to the acceptability of the bid.

The intent of the department is to not waive technicalities of the bidding procedure. The award of a contract shall be made on the basis of the lowest responsible and responsive bid.
