Sec. 21.

Written policy, procedure, and practice provide that juveniles are provided the right to appeal the disciplinary committee's decisions to the facility administrator, or their designee. Juveniles have up to ten (10) days of receipt of the decision to submit an appeal. The appeal is decided within ten (10) days of its receipt, and the juvenile is promptly notified in writing of the results. The appeal process shall consider the following:

(1) Whether there was substantial compliance with facility standards and procedures in handling the juvenile's discipline.

(2) Whether the disciplinary committee's decision was based on substantial evidence.

(3) Whether the sanction imposed was proportionate to the circumstances of the rule violation.
