Sec. 17.

(a) It is the policy of the commission to review and accept appropriate settlements. Nothing contained in this section shall be construed as precluding parties in a proceeding from submitting, prior to the issuance of a final order in the proceeding, settlement proposals or from requesting a hearing for that purpose.

(b) Settlement agreements by some or all of the parties to a proceeding may be filed with the commission and received into evidence as part of the record of the proceeding.

(c) The commission may reject, in whole or in part, a proposed settlement under this section if the commission determines that the settlement is not in the public interest. In the event that the commission rejects a proposed settlement, in whole or in part, the commission must state on the record or by written order the reasons for the rejection.

(d) The settlement must be supported by probative evidence.
