Section 14.1185 - Administrative Law Judge (ALJ)

a) Qualification. An ALJ must have knowledge of, and be willing to act consistent with, the policies of the Division of Aeronautics.
b) Duties and Authority. The ALJ shall have the following powers, in addition to any other specified in this Subpart K:
1) to give notice concerning and to hold
hearings;
2) to administer oaths
and affirmations;
3) to examine
witnesses;
4) to issue subpoenas
and to take or cause depositions to be taken;
5) to rule upon offers of proof and to
receive relevant evidence;
6) to
regulate the course and conduct of the hearing;
7) to determine the form in which evidence
shall be submitted and the number of copies to be supplied and
served;
8) to hold conferences,
before or during the hearing, for the settlement or simplification of
issues;
9) to rule on motions and
to dispose of procedural requests or similar matters;
10) to grant extensions of time on any matter
connected with the hearing;
11) to
take any other action authorized by this Part, or by any Illinois aeronautics
statute;
12) to waive, or otherwise
grant a variance from, such procedural requirements as may be helpful to avoid
an impracticable or unduly harsh consequence and which would not result in
harm, cost or inconvenience to other persons; and
13) to rule on requests for protective
Orders, which would prevent the disclosure of proprietary or personal
information, whose disclosure would not be a public benefit.
