Section 113.308 - Excess Shelter Allowance

a) Excess Shelter Allowance Payment for shelter expenses in excess of the Department's maximum allowance (see Section 113.248 ) shall be paid directly to the recipient, only upon receipt of prior approval from the Department which will be granted in the following situations:
1) the recipient suffers from a specific
infirmity which inhibits independent mobility such as blindness, is confined to
a wheelchair or is otherwise unable to negotiate stairs (as documented by the
recipient's medical information in the case record); and
2) suitable housing necessitated by
subsection
113.308(a)(1)
is only available at an expense in excess of the maximum allowance.
b) The recipient shall continue to be eligible for the Excess Shelter Allowance payment only as long as:
1) the recipient has unmet needs (as
determined by Department policy found at 89 Ill. Adm. Code 113: Subpart B and
C) in addition to the amount of excess shelter expenses; and
2) the recipient resides in the shelter
arrangement originally approved under subsection (a) above.
