Subpart C - NOTICE OF INTENT TO CONSTRUCT
Section 900.302 - Filing

An owner or operator shall file, on a form provided by the Department, a notice of intent to construct, for a livestock management facility or livestock waste handling facility with the Department prior to construction to establish a base date, which shall be valid for one year, for determination of setbacks in compliance with setback distances or, in the case of construction that is not a new facility or a facility of less than 50 animal units, with the maximum feasible location requirements of Section 35 of the Livestock Management Facilities Act.
