Section 120.20 - Purpose

a) The intent of this Part is to provide uniform direction for providers and individuals enrolled in the Medicaid home and community-based services waiver program.

b) The Department of Public Aid (DPA) is the single State agency designated to administer and oversee the administration of the Medicaid program under Title XIX, Medical Assistance, of the Social Security Act ( 42 U.S.C.A. 1395a(1996) and 42 CFR 431(1996) ) and the Illinois Public Aid Code [305 ILCS 5 ].

c) The Department is designated as the State agency having primary responsibility for overseeing the delivery of habilitation services to individuals with developmental disabilities under the Code.

d) The Department of Public Aid and the Department have entered into an interagency agreement to specify their respective roles and responsibilities regarding the home and community-based services waiver program for individuals with developmental disabilities.
