Section 830.601 - Scope and Applicability

a) This Subpart provides procedures by which the operator of any composting facility required, pursuant to 35 Ill. Adm. Code 831, to have a permit shall demonstrate compliance with the financial assurance plan requirement set forth in Sections 22.33 of the Act.
b) The operator is not required to comply with the provisions of this Subpart if the operator demonstrates that:
1) Closure
and post-closure care plans filed pursuant to 35 Ill. Adm. Code 724, 725, 807
or 811 will result in closure of the facility in accordance with the
requirements of this Part; and
2)
The operator has provided financial assurance adequate to provide for such
closure and post-closure care pursuant to 35 Ill. Adm. Code 724, 725, 807 or
811.
