Subpart D - REVOCATION AND REOPENING OF CLEAN AIR ACT PERMIT PROGRAM (CAAPP) PERMITS

a) Description. The provisions of this Subpart will apply to:
1)
Any revocation proceeding initiated by the Agency when it determines that there
are grounds to revoke and reissue a Clean Air Act Permit Program (CAAPP) permit
for cause, under Section 39.5(15)(b) of the Act; and
2) Any reopening proceeding initiated by the
Agency under a notice that there are grounds to terminate or revoke and reissue
a CAAPP permit for cause, under Section 39.5(16) of the Act.
b) Parties.
1) In a revocation proceeding initiated by
the Agency, the Agency will be named as petitioner and the holder of the CAAPP
permit will be named as respondent.
2) In a reopening proceeding initiated by the
Agency, the Agency will be named as petitioner and the holder of the CAAPP
permit will be named as respondent.
c) Filing and service. The filing and service requirements of 35 Ill. Adm. Code 101. Subparts C and J will apply to the proceedings of this Subpart.
