Section 2250.20 - Rulemaking

a) The Board shall comply with the rulemaking procedures contained within the Illinois Administrative Procedure Act [ 5 ILCS 100 ] and the rules promulgated under the Act in the adoption and filing of Board rules.
b) The Chairman of the Board may order the submission of views and comments orally at a special or regularly scheduled meeting of the Board, or he/she may refer the matter to:
1) a standing committee that shall conduct a
public hearing at which interested parties may submit evidence or express their
views on the proposed rulemaking;
2) a committee appointed by the Chairman;
or
3) a single Board member
designated by the Chairman.
c) Any interested person or group may request the Board to adopt, amend or repeal a rule. The request shall be directed to:

d) The request shall contain the following:
1) The name and address of the person or
group submitting the request.
2)
The specific rule of the Board that the requestor believes should be amended or
repealed, or the specific language the requestor believes should be adopted as
a rule by the Board.
3) Facts and
arguments in support of the proposed rulemaking.
4) The specific reason the requestor believes
that the Board should initiate the rulemaking action.
5) Identification of any person or group
adversely affected by the proposed rulemaking.
6) Specific reference to any existing rules
that are inconsistent with the proposed rulemaking.
