Rule 58.01.25 - RULES REGULATING THE IDAHO POLLUTANT DISCHARGE ELIMINATION SYSTEM PROGRAM
Section 58.01.25.400 - COMPLIANCE EVALUATION

01. Non-Compliance Actions. When the permittee is not in compliance with any condition of the existing or expired permit that has been administratively continued, the Department may choose to do one (1) or more of the following: (3-24-22)

a. Initiate an enforcement action; (3-24-22)

b. Issue a notice of intent to deny the new application. If the application is denied and the expired permit is no longer effective as provided in Subsection 101.02, the owner or operator must cease the activities authorized by the permit or be subject to enforcement action for operating without a permit; (3-24-22)

c. Issue a new permit with appropriate conditions; or (3-24-22)

d. Take other actions authorized by state law. (3-24-22)
