Rule 58.01.13 - RULES FOR ORE PROCESSING BY CYANIDATION
Section 58.01.13.450 - FINAL PERMIT DECISION

01. Notification of the Decision. The Director will provide notice of the final permit decision to each person or entity given notice under Subsection 400.03. This notice will include reference to the procedures for administrative appeal under Section 003. For the purpose of this section, a final permit decision means a final decision to issue, deny, or modify a permit. (3-24-22)

02. Response to Public Comments. The Director will prepare and make available to the public a response to relevant written comments received during the public comment period under Subsection 400.06. This response will: (3-24-22)

a. Specify which provisions, if any, of the draft permit have been changed in the final permit decision, and the reasons for the change; and (3-24-22)

b. Briefly describe and respond to all relevant written comments on the draft permit. (3-24-22)

03. Basis for Permit Denial. The Director will deny a permit if: (3-24-22)

a. The application is incomplete or inaccurate; (3-24-22)

b. The cyanidation facility as proposed cannot be conditioned for construction, operation, and closure so as to comply with applicable state law; or (3-24-22)

c. The Idaho Department of Lands has determined that the permanent closure plan does not meet the requirements of Chapter 15, Title 47, Idaho Code, or the rules promulgated thereunder. (3-24-22)

04. Immediate Effect of the Permit. A valid permit authorizes the construction and operation of a cyanidation facility in accordance with the terms of the permit. (3-24-22)
