01. Kinds of Discovery. The following kinds of discovery may be authorized by presiding officers in contested cases before the agency: (3-18-22)
a. Deposition through oral examination or
written questions; (3-18-22)
b.
Written interrogatories; (3-18-22)
c. Requests for Admission;
(3-18-22)
d. Requests for
production of documents, electronically stored information or tangible things;
and (3-18-22)
e. Entry upon land or
other property for inspection or other purposes; (3-18-22)
02. Rules of Civil Procedure. Unless otherwise provided by statute, rule, order or notice, the scope of discovery is governed by the Idaho Rules of Civil Procedure (see Idaho Rule of Civil Procedure 26). (3-18-22)
