Section 20.03.02.112 - DECISION TO APPROVE OR DISAPPROVE OF A PERMANENT CLOSURE REPORT

01. Receipt of a Permanent Closure Report. Within sixty (60) days of receipt of a permanent closure report, the director shall issue to the operator a director's determination of approval or disapproval of the permanent closure report. (3-18-22)

02. Permanent Closure Report Is Disapproved. The director's determination to approve or disapprove a permanent closure report will be based on the permanent closure report's demonstration that permanent closure has resulted in long-term neutralization of process waters and material stabilization. If a permanent closure report is disapproved, the director shall provide in writing identification of: (3-18-22)

a. Errors or inaccuracies in the permanent closure report; (3-18-22)

b. Issues or details that require additional clarification; (3-18-22)

c. Failures to fully implement the approved permanent closure plans; (3-18-22)

d. Failures to ensure protection for public health, safety, and welfare or to prevent degradation of waters of the state; (3-18-22)

e. Outstanding violations or other noncompliance issues; and (3-18-22)

f. Other issues supporting the Department's disagreement with the contents, final conclusions or recommendations of the permanent closure report. (3-18-22)
