(a) Any party negotiating an agreement for access to a pole, duct, conduit, or right-of-way may, at any point in the negotiation, petition the commission in writing for the commission to participate in the negotiation and mediate any differences arising in the course of negotiation. In that event, the provisions of will apply.

(b) During the period from the one hundred thirty-fifth to the one hundred sixtieth day (inclusive) following the date upon which a utility receives a bona fide request for access to a pole, duct, conduit, or right-of-way, the utility or any other party to the negotiation may petition the commission in writing for the commission to arbitrate any unresolved issues. In that event, the provisions of § 6-80-53 will apply.
