Any oral or documentary evidence that is relevant and material to the charge may be admitted, provided that the commission's findings must be based upon competent and substantial evidence in accordance with section 84-31(c), HRS, Effect shall be given to the rules of privilege recognized by law. The presiding officer may take notice of judicially recognizable facts.
