The department of transportation recognizes the utility's franchise to occupy the rights-of-way of state highways in providing essential services and commodities to the public. Therefore, utility facilities may be accommodated in the state highway rights-of-way provided that the use and occupancy do not interfere with the free and safe flow of traffic or otherwise impair the highway or its visual quality and does not conflict with the provisions of federal, state or local laws or regulations or the provisions of this chapter.
