(a) Any person, agency, or organization desiring or planning to operate a program of investigation, placement, and supervision of children in foster care shall be required to obtain a certificate of approval from the department prior to engaging in any phase of child-placing activities.

(b) Parents, legal custodians, or legal guardians, who are willing and able to provide a safe home for their child if it were not for the child's extraordinary medical, physical, or psychological needs, do not need to obtain a certificate of approval from the department and do not need to meet the licensing requirements of this chapter in order to place and supervise their own child.

(c) The department shall not issue a certificate until information required by this chapter is submitted to the department establishing that the organization is properly qualified to act in a child-placing capacity.
