(a) The operation of a child care facility without a license is a violation and shall be punishable by a fine not to exceed the maximum amount allowable under the law.
(b) The following offenses may be punishable by a fine, not to exceed the maximum amount allowable under the law, and may also be subject to the denial, suspension, or revocation of a license:
(1) Caring for more children than allowed by
the facility's license;
(2)
Violation of the staff-child ratios;
(3) Improperly certifying staff
credentials;
(4) Failure to comply
with timely request for criminal history records check;
(5) Allowing conditions to exist at the
facility which constitute an imminent danger to the health, welfare, or safety
of the children; or
(6) Injuries to
children due to staff negligence.
