Section 17-794.1-60 - Administrative hearing request

(a) A recipient who is dissatisfied with the department's adverse action affecting the assistance claim shall be provided an opportunity for an administrative hearing in accordance with chapter 17-602.1.

(b) Every recipient shall be informed in writing at the time of entry into the FTW program, or at the time of any action affecting the individual's assistance claim, of the:

(1) Individual's right to an administrative hearing;

(2) Method for obtaining a hearing; and

(3) Individual's right to present the administrative appeal independently or be represented by an authorized representative such as legal counsel, relative, friend, or any other person of the individual's choice.
